Welcome to Kev’s Gym. By accessing or using our website, services, classes, programs, or other offerings, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Acceptance of Terms

By using our website or engaging with our services, you agree to comply with and be bound by these Terms and Conditions, our Privacy Policy, and any additional policies, guidelines, or rules applicable to the services you use.

2. Eligibility

You must be at least 18 years old to independently use our services or participate in our fitness programs. Individuals under 18 may participate only with the consent of a parent or legal guardian and subject to any additional requirements established by Kev’s Gym.

3. Health and Fitness Disclaimer

Participation in physical fitness activities involves inherent risks. By participating in any Kev’s Gym class, program, training session, or other fitness activity, you acknowledge and agree that:

• You are responsible for determining whether you are physically capable of participating in the applicable activity.
• You should consult with a qualified healthcare professional before beginning a new fitness program, particularly if you have a preexisting medical condition, injury, or other health concern.
• You are responsible for informing your instructor of any relevant physical limitations, injuries, or conditions that may affect your ability to participate safely.
• You voluntarily assume the risks associated with participation in physical fitness activities.

To the fullest extent permitted by applicable law, Kev’s Gym, LLC, its employees, contractors, instructors, representatives, and affiliates are not responsible for injuries, illnesses, losses, or damages resulting from participation in our fitness programs or services, except where liability cannot lawfully be excluded or limited.

4. Membership, Classes, and Services

Unless otherwise stated in a separate agreement or service-specific policy:

• Memberships, class passes, packages, and other purchased services are non-transferable.
• Applicable expiration dates, pricing, and service terms will be communicated at the time of purchase or booking.
• Participants are expected to arrive on time and follow reasonable safety instructions provided by instructors or staff.
• Kev’s Gym reserves the right to refuse, suspend, or discontinue services when necessary for safety, misconduct, nonpayment, violation of these Terms, or other legitimate business reasons.

Certain services may be subject to additional agreements, policies, cancellation requirements, or terms provided at the time of booking or enrollment. If those terms conflict with these general Terms and Conditions, the service-specific terms will govern with respect to that service.

5. Cancellations and Refunds

Cancellation requirements may vary depending on the service purchased and will be communicated at the time of booking or in the applicable service agreement.

Unless otherwise specified, scheduled appointments or classes should be canceled at least 24 hours before the scheduled start time. Late cancellations or missed appointments may result in applicable charges or loss of a service credit.

Refunds are provided in accordance with the applicable service agreement, purchase terms, and applicable law.

6. Privacy and Personal Information

Kev’s Gym is committed to protecting personal information. Information collected through our website, forms, communications, or services is handled in accordance with our Privacy Policy.

By using our website or services, you acknowledge that information may be collected and processed as described in the Privacy Policy.

7. Intellectual Property

Unless otherwise indicated, content owned by Kev’s Gym and made available through our website or services—including our logos, branding, graphics, photographs, videos, written content, training materials, and other original materials—is owned by or licensed to Kev’s Gym, LLC and may be protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, publish, sell, or commercially use Kev’s Gym intellectual property without prior written authorization, except as permitted by applicable law.

8. Code of Conduct

Clients, participants, applicants, visitors, and other individuals interacting with Kev’s Gym are expected to:

• Treat instructors, staff members, clients, and others with respect.
• Follow reasonable health and safety instructions.
• Refrain from threatening, abusive, discriminatory, harassing, fraudulent, or otherwise inappropriate conduct.
• Avoid conduct that interferes with the safe and effective delivery of Kev’s Gym services.

Kev’s Gym may suspend or terminate services or access for violations of these standards, subject to applicable agreements and law.

9. SMS/Text Messaging Terms

Kev’s Gym may offer SMS/text messaging for individuals who voluntarily provide their mobile telephone number and expressly consent to receive text messages.

Depending on the individual’s relationship with Kev’s Gym and the consent provided, messages may include responses to inquiries, customer support communications, appointment and scheduling information, reminders, service updates, application and interview communications, onboarding information, employment-related communications, and other communications the individual has requested or consented to receive.

Message frequency varies. Message and data rates may apply.

Consent to receive SMS messages is voluntary and is not a condition of purchasing goods or services, submitting an application, obtaining employment, or otherwise doing business with Kev’s Gym.

You may opt out of SMS communications at any time by replying STOP to a message from Kev’s Gym. After opting out, you may receive a confirmation message. You will no longer receive SMS messages from that number unless you subsequently opt in again.

Kev’s Gym does not sell or share mobile phone numbers or SMS opt-in/consent information with third parties or affiliates for their marketing or promotional purposes.
